Abstract
This chapter focuses on three global interests of grave concern and have been adverted to, in differing measure namely; security, health and environmental protection. Another common theme that should inform consideration of topic is the existence of certain synergies, as opposed to conflicts, between the types of interests identified. The question of transport of reprocessed nuclear fuel and the problem posed by the threats of environmental damage associated with such transport. The approach to interpretation of the Convention articulated by Professor Miyoshi should be the point of departure for identifying the core rights and duties. In this connection, as a practical matter, particular attention should be devoted to the exclusive economic zone (EEZ) and to straits. The critical point is that the regulations are to be international, not unilateral, and they are to be promulgated within the framework of UNCLOS.
